Jim Truitt successfully defended a title insurance underwriter in a coverage dispute where the insured fee owner sought damages for the underwriter’s refusal to provide a defense and indemnification under a title insurance policy. The court agreed with Jim Truitt’s argument that the insured failed to comply with the policy’s notice requirements, which relieved the title underwriter of any obligation to defend or indemnify the insured for its alleged loss of title. The court further agreed with Jim Truitt’s argument that the insured ultimately obtained the precise real estate that it contracted to purchase from its grantor and therefore suffered no loss under the title insurance policy.
